By downloading, installing, accessing, or using the Octocode software stack (including the CLI, MCP Server, and VS Code Extension), you agree to be bound by these Terms of Usage ("Terms"). If you do not agree to these Terms, do not use the software.

The Octocode software is licensed under the **MIT License**.
This is a permissive open-source license that allows you to:
- Use the software for any purpose (personal or commercial).
- Modify and distribute the software.
- Use the software in proprietary projects.
The only requirement is that you include the original copyright notice and license in any copy of the software/source.

The source code is open and available for use under the terms of the MIT License.

While the software is free to use, we offer commercial support packages for enterprises that require:

## 4. Telemetry and Privacy
We collect certain de-identified usage data to improve the software. Octocode never collects Personally Identifiable Information (PII), Secrets (OR API Keys) or actual code. By using Octocode, you acknowledge that we may collect and use data as described in our [Privacy Policy](./PRIVACY.md).
You may opt-out of telemetry at any time by setting the environment variable `OCTOCODE_TELEMETRY_DISABLED=1` or configuring your user settings as described in the Privacy Policy.
## 5. Prohibited Conduct
You agree not to:
- Use the software for any illegal purpose.
- Remove or alter the copyright notices or license terms in the software.
- Attempt to flood or disrupt our telemetry services.
