Welcome to Glama.com ("Glama", "we", "us", or "our"). Glama provides a ChatGPT for teams, allowing users ("you") to collaborate, communicate, and enhance productivity through AI-driven conversations. Our service is accessible via our website located at https://glama.ai (the "Website").

Please read these Terms of Service ("Terms") carefully before using the Website. By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.

1. Services Provided

Glama offers an AI-driven chatbot service designed for team collaboration. This includes, but is not limited to, facilitating communication, managing tasks, and providing AI-generated insights to enhance team productivity. We employ advanced machine learning technologies to process and present this data. Our services leverage APIs provided by OpenAI, Anthropic, and Google, as well as our own self-hosted models.

2. Use of the Service

You are granted a non-exclusive, non-transferable, revocable license to access and use the Website strictly in accordance with these Terms. As a condition of your use of the Website, you warrant that you will not use the Website for any purpose that is unlawful or prohibited by these Terms.

3. User Responsibilities and Conduct

You are responsible for all your activities while using the Website. You acknowledge that you must evaluate, and bear all risks associated with, the use of any content, including any reliance on the accuracy, completeness, or usefulness of such content.

In addition, you agree not to:

  • Use the Website in any way that violates any applicable local, state, national or international law or regulation
  • Impersonate or attempt to impersonate Glama, a Glama employee, another user, or any other person or entity
  • Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Website, or which, as determined by us, may harm Glama or users of the Website or expose them to liability

4. User Accounts

If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account. You must immediately notify Glama of any unauthorized uses of your account or any other breaches of security.

5. Data Security and Confidentiality

Glama takes the security and confidentiality of your data seriously. We implement and maintain appropriate technical, security and organizational measures to protect User Data against unauthorized or unlawful processing and use, and against accidental loss, destruction, damage, theft or disclosure. However, no method of transmission over the internet, or method of electronic storage is 100% secure.

We follow generally accepted industry standards to protect the User Data submitted to us, both during transmission and once we receive it. Some of the safeguards we use are:

  • Encryption of data in transit and at rest
  • Regular security audits and penetration testing
  • Access controls and authentication mechanisms
  • Secure data backups
  • Employee training on data protection and security best practices

Glama employees may access and use User Data only to provide, maintain, and improve the Service, to assist you with support requests, or to prevent or address technical issues and violations of our Terms of Service.

We retain User Data for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

6. Data Processing and GDPR Compliance

Glama is committed to complying with the General Data Protection Regulation (GDPR) and other applicable data protection laws. We act as a data processor for the personal data you submit through our service.

By using our service, you acknowledge and agree that:

  • You are the data controller for any personal data you input into our system, and you are responsible for ensuring you have the necessary rights and consents to process this data.
  • Glama will only process personal data on your behalf and in accordance with your instructions, as outlined in these Terms and our Data Processing Agreement.
  • We will implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk, as required by GDPR Article 32.
  • We will assist you in responding to requests from data subjects exercising their rights under the GDPR.
  • We will notify you without undue delay after becoming aware of a personal data breach.
  • Upon termination of services, we will delete or return all personal data to you, unless required by law to retain some or all of the data.

For transfers of personal data outside the European Economic Area (EEA), we ensure appropriate safeguards are in place, such as Standard Contractual Clauses or adequacy decisions.

If you are located in the EEA or the personal data you input relates to individuals in the EEA, you agree to enter into our Data Processing Agreement if required by applicable law.

7. Subscription and Billing

Glama operates on a subscription-based model. By subscribing to our service, you agree to the following terms:

  • The subscription fee is USD 10 per user per month.
  • There is a minimum requirement of 4 users per subscription.
  • Billing is conducted on a monthly basis.
  • Charges are based on the number of active users in your team for each billing month.

Billing Cycle: Your subscription will automatically renew each month on the anniversary of your initial subscription date, unless cancelled. You will be billed in advance for the upcoming month's service.

User Count: The number of active users in your team is calculated at the end of each billing cycle. An active user is defined as any user who has accessed the service at least once during the billing period.

Payment Method: You agree to provide us with a valid payment method for paying all fees. You authorize us to charge your payment method for all fees incurred.

Changes in Fees: We reserve the right to change our subscription fees. If we do so, we will provide notice of the change on our website or by email, at least 30 days before the change takes effect.

Refunds: As a general policy, all fees are non-refundable. However, we may, at our sole discretion, provide a refund, discount or other consideration in certain circumstances. Please contact our support team to discuss any billing issues.

Taxes: Our fees do not include any taxes, levies, duties or similar governmental assessments, including value-added, sales, use or withholding taxes assessable by any local, state, provincial or foreign jurisdiction. You are responsible for paying all such taxes associated with your subscription.

Cancellation: You may cancel your subscription at any time. Upon cancellation, you will have access to the service until the end of your current billing period. No refunds will be provided for unused time in the last billing period.

8. Team Collaboration and Data Sharing

You acknowledge that content shared within your team may be visible to other team members. It is your responsibility to ensure that any data you share complies with applicable laws and regulations, including those related to data privacy and protection.

9. Intellectual Property

All content included on the Website, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Website, is the property of Glama or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.

10. Disclaimers

Glama does not guarantee the accuracy, completeness, or usefulness of any information on the Website and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made. The data may contain inaccuracies and typographical errors. Glama expressly disclaims liability for any such inaccuracies or errors.

The information provided on the Website is for general informational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or dietary supplement.

11. Privacy and User-Generated Content

Users may generate content while using the service. You retain ownership of your content and grant Glama a limited license solely to host and store such content for the purpose of providing the service. All chats and uploaded information remain private and confidential, accessible only to you and authorized users within your private workspace. Glama will not use, reproduce, modify, create derivative works, communicate, publish, publicly perform, publicly display, or distribute your content without your explicit consent. Ensure that your content complies with these Terms and all applicable laws.

12. Third-Party Services and APIs

Our services integrate APIs from third-party providers including OpenAI, Anthropic, and Google, along with our own self-hosted models. By using the Website, you acknowledge and agree to the terms and policies of these third-party providers. Glama is not responsible for any actions or policies of these third parties.

13. Limitation of Liability

Glama shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Website; (ii) any content obtained from the Website; and (iii) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

14. Indemnification

You agree to indemnify, defend and hold harmless Glama, its officers, directors, employees, agents, and third parties, from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your use of or inability to use the Website, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules, or regulations.

16. Communication Consent

By providing Glama with your email address, you consent to our using the email address to send you Website-related notices, including any notices required by law, in lieu of communication by postal mail.

17. Termination

We may terminate or suspend your access to all or part of the Website, without notice, for any conduct that we, in our sole discretion, believe is in violation of any applicable law or is harmful to the interests of another user, a third-party, or us.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain.

19. Changes to Terms

Glama reserves the right, in its sole discretion, to change the Terms under which the Website is offered. The most current version of the Terms will supersede all previous versions. Glama encourages you to periodically review the Terms to stay informed of our updates.
